This website is operated by Hoshi. Throughout the site, the terms “we,” “us,” and “our” refer to Hoshi.
Hoshi operates this website and store, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”).
Please read these Terms of Service carefully. They contain important information about your legal rights and responsibilities, including limitations of liability and warranty disclaimers.
By visiting, accessing, interacting with, or purchasing through our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use the Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or jurisdiction of residence.
To use certain parts of the Services or place an order, you may be asked to provide information including your name, email address, billing details, payment information, and shipping address.
You agree that all information you provide is accurate, current, and complete.

We make reasonable efforts to display and describe our products accurately. However, product colours, appearance, packaging, dimensions, and other visual details may vary depending on your device, screen settings, manufacturing updates, or product revisions.
We do not guarantee that every product will appear exactly as shown on the Website.
Product descriptions, pricing, availability, packaging, specifications, and offers may be changed at any time without prior notice.
We may discontinue products or limit quantities available to any person, household, geographic region, or jurisdiction.
Wellness, supplement, pet, and filtration products
Information provided through the Services is for general informational purposes only.
Human wellness and supplement information is not intended to diagnose, treat, cure, or prevent disease and is not a substitute for advice from a qualified healthcare professional.
Pet wellness information is not veterinary advice. Consult a licensed veterinarian regarding your pet’s health, diet, medication, or supplementation.
Claims relating to shower, water, air, or other filtration products are subject to the specifications, testing, installation conditions, water or air quality, usage, maintenance, and other factors applicable to the individual product.

SECTION 3 — ORDERS
When you submit an order, you are offering to purchase the selected products.
Hoshi may accept, reject, limit, or cancel an order for legitimate business, inventory, fraud-prevention, pricing, payment, legal, or operational reasons.
Your order is not considered accepted until payment has been successfully processed and we confirm the order.
Please review your order carefully before submitting it. We may not be able to modify or cancel an order once processing has begun.
If we cancel an order after payment has been collected, the applicable amount will be refunded to your original payment method.
Purchases are intended for personal or household use unless we expressly approve otherwise. Unauthorized resale or redistribution is prohibited.
SECTION 4 — PRICES AND BILLING
Prices, discounts, bundles, and promotions may change without notice.
The price charged for a product will generally be the price shown at checkout at the time the order is submitted.
Unless otherwise stated, product prices may not include taxes, shipping charges, customs duties, import fees, or other charges that may apply.
You agree to provide accurate and complete billing and payment information and to promptly update that information when necessary.
By providing payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to process the amounts displayed at checkout.
SECTION 5 — SUBSCRIPTIONS AND RECURRING ORDERS
Certain Hoshi products may be offered through an optional subscription or recurring-purchase program.
If you enroll in a subscription, the applicable price, discount, billing frequency, shipment frequency, and other recurring terms will be disclosed before checkout.
By purchasing a subscription, you authorize Hoshi and its payment providers to charge your selected payment method automatically according to the frequency shown at checkout until the subscription is cancelled or otherwise ended.

Cancellation affects future recurring orders and may not cancel an order that has already been processed.
Any additional subscription terms shown at checkout or in our Cancellation Policy also apply.
SECTION 6 — SHIPPING AND DELIVERY
Shipping times are estimates and are not guaranteed unless we expressly state otherwise.
We are not responsible for delays caused by shipping carriers, customs, weather, labour disruptions, incorrect addresses, or other events outside our reasonable control.
You are responsible for providing a complete and accurate shipping address.
If you notice an error in your shipping information, contact us as soon as possible at support@tryhoshi.co. We will try to assist, but we cannot guarantee that an order can be changed after processing begins.

SECTION 7 — RETURNS AND REFUNDS
Returns, exchanges, guarantees, and refunds are governed by our then-current Refund Policy.
If a product arrives damaged, incorrect, or otherwise eligible for a return or refund, please follow the process described in our Refund Policy or contact:
Any money-back guarantee advertised for a specific product is subject to the terms shown on the applicable product page and in our Refund Policy.
SECTION 8 — INTELLECTUAL PROPERTY
The Services, including Hoshi trademarks, logos, product names, text, graphics, photography, video, reviews, designs, layouts, and other content, are owned by or licensed to Hoshi and are protected by applicable intellectual-property laws.
These Terms allow you to access and use the Services for personal, non-commercial purposes only.
You may not reproduce, distribute, modify, publish, display, sell, license, scrape, commercially exploit, or create derivative works from protected Hoshi content without prior written permission.
Nothing in these Terms transfers ownership of Hoshi intellectual property to you.
SECTION 9 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
We may provide access to tools, apps, services, integrations, or functionality operated by third parties.
We do not control all third-party services and do not guarantee their availability, accuracy, security, or performance.
Your use of third-party services may be subject to separate terms and privacy policies.
Use of such tools is at your own discretion and risk.

We do not control and are not responsible for third-party websites, content, products, services, privacy practices, or terms.

SECTION 11 — RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify.
Shopify provides the ecommerce technology that allows us to offer products and Services to you, but purchases made from our store are transactions between you and Hoshi.
Shopify is not the seller of Hoshi products and is not responsible for product performance, fulfillment, customer service, returns, refunds, or other obligations of Hoshi.
Certain information may be processed by Shopify in order to provide and improve its services.
SECTION 12 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.
Because our store is hosted by Shopify and may use third-party apps and service providers, personal information may also be processed by those providers as necessary to operate the store, process payments, fulfill orders, provide subscriptions, perform analytics, or deliver other functionality.

SECTION 13 — FEEDBACK, REVIEWS, AND SUBMISSIONS
If you submit reviews, comments, photos, videos, ideas, suggestions, testimonials, or other content to Hoshi, you represent that you have the right to provide that content.
Unless otherwise agreed in writing, you grant Hoshi a non-exclusive, worldwide, royalty-free, sublicensable right to use, reproduce, modify, publish, display, distribute, and promote that content in connection with Hoshi’s business, marketing, advertising, and Services, subject to applicable law.
You agree not to submit content that is unlawful, misleading, defamatory, infringing, abusive, fraudulent, or otherwise violates the rights of another person.
Reviews and testimonials reflect individual experiences and do not guarantee that every customer will have the same result.
SECTION 14 — ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, or other information.
We reserve the right to correct errors, update information, modify or cancel offers, and cancel orders affected by material errors, subject to applicable law.

- engage in conduct that could harm Hoshi, Shopify, our customers, or third parties.
We may suspend or terminate access to the Services if we reasonably believe these Terms have been violated.
SECTION 16 — TERMINATION
We may suspend or terminate your access to all or part of the Services where permitted by law.
Termination does not affect obligations that accrued before termination.
Sections that by their nature are intended to survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions — will continue to apply.
SECTION 17 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and products made available through the Services are provided on an “as is” and “as available” basis unless we expressly state otherwise.
We do not guarantee that the Services will always be uninterrupted, secure, timely, or error-free.
Except where prohibited by law, we disclaim implied warranties or conditions including merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
Some jurisdictions do not permit certain warranty limitations, so some of these limitations may not apply to you.
SECTION 18 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Hoshi and its affiliates, officers, directors, employees, contractors, agents, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or related to your use of the Services or products purchased through the Services.
This may include loss of profits, revenue, savings, data, goodwill, or replacement costs.
Where applicable law does not allow a particular limitation or exclusion, that limitation will apply only to the maximum extent permitted by law.
Nothing in these Terms limits rights or remedies that cannot legally be excluded.
SECTION 19 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Hoshi, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, or reasonable legal costs arising from:
- your material breach of these Terms;
- your violation of applicable law;
- your infringement of another person’s rights; or
- your misuse of the Services.
SECTION 20 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will continue in full force and effect.
SECTION 21 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.
These Terms, together with policies and other terms incorporated by reference, constitute the agreement between you and Hoshi regarding your use of the Services.
SECTION 22 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the Hoshi business, subject to applicable law.
SECTION 23 — GOVERNING LAW
These Terms and any separate agreements through which we provide the Services will be governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any mandatory consumer rights that apply in your jurisdiction, you and Hoshi agree that disputes relating to these Terms, the Services, or Hoshi products will be brought before the courts located in Toronto, Ontario, Canada.

Section headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.
SECTION 25 — CHANGES TO THESE TERMS
You may review the most current version of these Terms on this page at any time.
We may update, revise, or replace portions of these Terms by posting an updated version on the Website.
Where required by law, we will provide notice of material changes.
Your continued use of the Services after revised Terms become effective constitutes acceptance of those changes to the extent permitted by law.
